Legal Data Considerations Platform Terms
Overview
Stay compliant with international copyright laws, different jurisdictions have different rules, if resources required to stay legal in all jurisdictions are not possible err on the side of caution in order to not break laws
Safe Harbor
Act Neutral
- Not edit, be selective, or initiate transmission of user content
- platform code cannot scrape a website or computer and upload content
- platform cannot filter the uploads in any way, eg by content
- can filter according to metadata such as size, file type, anything that does not inspect content
- can filter for copyright breaches
- can optimize or compress
- cannot modify the substance of the content, eg adding audio or watermarks
- when rejecting a file do not suggest it was due to editorial review
No Blind Eye
- If blatant copyright infringements exist platform is expected to be proactive
- Some jurisdiction laws require suspension of users who repeatedly breach copyright law, must study and implement process
Notice and Takedown
- study requirements for judging validity of copyright breach notification
- study requirements for removing content once validity is confirmed and create mechanism to do this
Counter Notices
- There are laws regarding counter notices
- If a valid counter notice is received are liable for putting content back up
- Must create method for submitting counter notices
